Is the error you mention on the client? I assume you know that you can manually add OS versions to the compliance policy in the EMM console?
We have found out what the problem was. The upgrade on the server side was marking users as deleted. This caused EMM to see the users as not in AD anymore. The error i was getting on phones were due to not showing active.
