This would imply that the server isn't able to talk to the Avert servers to get the most recent version... if you check avertlog.htm in the DB\AVERT folder, does it list any problems connecting to Avert?
Ahh you just made me remember that networking shutdown a lot of outbound ports the other day. It's still pulling down new dats, it just seems to be confused on what the latest one is. I need to figure out what ports it uses

But the avertlog.xml has:

What did you do to fix this? All my ePO4 servers quit talking to myavert on 9/16/2009
Seanmcd is correct - the server needs to be able to reach myavert.avertlabs.com on port 8801. Check your firewalls :)
no mine actually does the same thing in 3.61 patch 4. It used to match.
Same problem for us. Is there a fix ?
