MSME (8.5) non-complaint in report

I have run the same report for well over a year now and this is the first time I can remember MSME showing as non-complaint. The only thing that has changed from yesterday (when it worked) to today when it hasn't is the Agent was upgraded from 4.8 to 5.0.

Criteria: (Last Communication Is within the last 1 Weeks and DAT Version (McAfee Security for Microsoft Exchange) Is within X versions of repository 2 )

Dat on the server is listed as version 7829, was 7828 before I forced through the latest update.

I tried removing communication day and increasing dat to 4 days but still non-compliant. I'm guessing the issue is with the new Agent.

Updated to Agent 5.0.1 and now it reports correctly including pulling policies from EPO.

They have asked me to update the Agent to 5.0.1 so guess I will do that. Also our MSME isn't pulling policies from ePO again even though I recreated all the policies twice and set them back to my defaults.
